Terms of Service
By creating an account or using the Service you accept these Terms. If you do not accept them, do not use the Service.
1. The Service
JOSH is a community-driven platform that lets users:
- Photograph job advertisements found in physical, publicly accessible locations (shop windows, restaurant doors, notice boards);
- Share these photographs with other users via a feed and an interactive map;
- Discover job opportunities posted by other users;
- Earn experience points (“XP”) and progress through “Hunter Ranks” through participation.
JOSH is not an employment agency, recruiter, or party to any employment relationship arising from a job advertisement displayed in the Service. We do not verify the accuracy of advertisements, the existence of the jobs, the legitimacy of the employer, or the terms of employment. You contract directly with the advertising employer at your own risk.
2. Eligibility
You may use the Service only if:
- You are at least 16 years old (residents of the EU/EEA) or at least 13 years old (rest of the world) — and in any case at least the minimum age in your jurisdiction for forming a binding contract;
- You have not been previously banned from the Service;
- Your use complies with all applicable laws of your country of residence and any country in which you take photos.
If you are using JOSH on behalf of a business, you represent that you have authority to bind that business to these Terms.
3. Accounts
3.1 Registration
To use most features you must create an account by providing an email address and password, or by signing in with Google or Apple. You agree to:
- Provide accurate, complete information;
- Keep your credentials confidential;
- Notify us immediately if you suspect unauthorized use of your account;
- Take responsibility for all activity under your account.
3.2 Display name
Your display name will be visible to other users. Choose a name that:
- Is not misleading (e.g. impersonating someone else);
- Is not offensive or discriminatory;
- Does not contain contact details, URLs, or commercial promotion.
We may require you to change a non-compliant display name.
3.3 Account closure
You may delete your account at any time via Settings → Account → Delete account. On account deletion we will hard-delete your data within 30 days as described in our Privacy Policy. Some content (e.g. records of moderation actions, anonymized statistics) may be retained for legal compliance.
We may suspend or terminate your account, with or without notice, if you violate these Terms or applicable law (Section 11).
4. Your Uploads — Acceptable Content
4.1 What you may upload
You may upload only photographs that:
- (a) Show a job advertisement that was visible in a publicly accessible place at the time you took the photo;
- (b) Were taken by you, or that you have an unrestricted right to share;
- (c) Do not feature identifiable individuals in a primary or recognizable way without their consent (faces of passers-by, employees behind windows, etc. should be cropped or blurred);
- (d) Do not contain payment card numbers, identity documents, social security numbers, or other obviously sensitive personal data of third parties;
- (e) Comply with the laws of the country where the photo was taken (including private property and copyright rules).
4.2 What is prohibited
You may not upload, share, post, or transmit any content that:
- Is unlawful, fraudulent, defamatory, libellous, threatening, harassing, hateful, abusive, obscene, or invasive of another’s privacy;
- Promotes violence, terrorism, self-harm, illegal drugs, weapons, sex work, or human trafficking;
- Discriminates on the basis of race, ethnicity, gender, sexual orientation, religion, disability, age, or any other characteristic protected by applicable law;
- Constitutes spam, repeated duplicate posting, or commercial promotion unrelated to a real job opportunity;
- Infringes intellectual property rights of any party (trademarks, logos, photographs, text);
- Contains malware, exploits, or anything intended to disrupt the Service;
- Misrepresents your identity or affiliation;
- Is staged, fabricated, AI-generated, or otherwise not a genuine job advertisement found in a public place;
- Includes a hidden contact channel intended to bypass our reporting system;
- Is otherwise prohibited by Apple App Store or Google Play store policies (objectionable content provisions).
4.3 Anti-discrimination commitment
By uploading a job advertisement, you confirm to the best of your knowledge that the underlying advertisement does not discriminate against candidates based on protected characteristics. You acknowledge that, where applicable, the original advertiser remains the responsible party for the content of the advertisement under labour and equality law. We may remove discriminatory content at our discretion.
4.4 Quality and freshness
The Service expects timely, factual contributions:
- A job ad becomes inactive after 30 days unless re-confirmed by another user;
- Repeated uploads of expired or fake ads may result in XP forfeiture and account suspension;
- The “Confirm still posted” feature is intended for ads you have personally re-verified, not for XP farming.
5. Intellectual Property
5.1 Your content — licence to JOSH
You retain all ownership rights in the photos and other content (“User Content”) you upload to the Service. By uploading, you grant JOSH a worldwide, non-exclusive, royalty-free, sublicensable, transferable licence to host, store, reproduce, modify, create derivative works from, communicate, publish, publicly perform, publicly display, and distribute your User Content for the purpose of operating, promoting, and improving the Service.
This licence:
- Is irrevocable while the User Content remains in the Service;
- Survives termination of your account only to the extent reasonably necessary for caching, backups, legal compliance, and content displayed to other users before deletion;
- Does not authorize JOSH to sell your User Content as a stand-alone product, nor to license it to advertisers or data brokers.
You waive any moral rights in your User Content to the extent permitted by applicable law for the purposes of this licence.
5.2 Other users’ content
When you view content uploaded by other users, you may use it solely for personal, non-commercial purposes within the Service. You may not scrape, crawl, copy, or republish other users’ content elsewhere.
5.3 Our intellectual property
The JOSH name, logo, app design, source code, brand elements, and all related materials are the exclusive property of [JOSH legal entity] and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any rights in our intellectual property except the limited right to use the Service as intended.
5.4 Copyright complaints (DMCA / EU Copyright Directive)
If you believe content on the Service infringes your copyright, send a notice to [copyright@josh-app.example] including:
- A description of the work claimed to be infringed;
- The location (URL or in-app reference) of the allegedly infringing material;
- Your name, address, telephone number, and email;
- A statement that you have a good-faith belief that the use is unauthorized;
- A statement, under penalty of perjury, that the information is accurate and you are authorized to act for the rightsholder;
- A signature (electronic or physical).
We will remove or disable access to the contested content and notify the uploader, who may submit a counter-notice.
6. Gamification, XP, and Hunter Ranks
JOSH awards XP for actions such as uploading a job, getting views, confirming a job is still posted, and maintaining a daily login streak. XP and Hunter Ranks have no monetary value, are not redeemable for cash, prizes, or services, and may be adjusted, reset, or revoked at our reasonable discretion if we detect abuse or system error. We reserve the right to change the XP system, level thresholds, and reward structure at any time.
7. Privacy
Your use of the Service is also governed by our Privacy Policy, which forms part of these Terms. Please read it carefully.
8. Notifications
By creating an account, you agree to receive transactional notifications necessary for the operation of the Service (e.g. password reset emails, security alerts, Statements of Reasons for moderation actions). You can opt out of non-transactional push notifications (daily streak reminders) in Settings.
9. Reporting Illegal or Harmful Content
In line with the EU Digital Services Act (DSA), the Service includes a notice-and-action mechanism. To report content:
- In-app: tap the “Report” action on the relevant item and select a reason;
- By email: write to [legal@josh-app.example] with a precise description of the content and its location.
You will be informed of the outcome of your report. If your own content is removed, you will receive a Statement of Reasons and an opportunity to appeal (Section 10 of the Privacy Policy).
For any other contact with EU authorities or regulators concerning the Service, our single point of contact under Articles 11–12 DSA is [legal@josh-app.example].
10. Repeat-Infringer Policy
We will, in appropriate circumstances and at our discretion, suspend or terminate the accounts of users who repeatedly upload infringing or unlawful content. We maintain internal records of moderation actions sufficient to identify repeat infringers in compliance with the DSA.
11. Suspension and Termination
We may, at our reasonable discretion and without prior notice where lawful and necessary:
- Remove or restrict access to specific User Content;
- Suspend your account temporarily;
- Terminate your account permanently;
- Refuse future registration;
if we believe you have:
- Violated these Terms or applicable law;
- Created risk or possible legal exposure for us or other users;
- Engaged in fraud, manipulation of the XP system, or attempts to circumvent moderation.
Where lawful, we will give you advance notice and an opportunity to remedy the breach. Termination is effective immediately and you remain liable for any obligations accrued before termination. The provisions of Sections 5, 12, 13, 14, and 17 survive termination.
12. Disclaimers
To the fullest extent permitted by applicable law:
- The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or uninterrupted operation.
- We do not warrant the accuracy, completeness, currency, or legality of any User Content, including job advertisements.
- We are not a party to any employment relationship resulting from a contact made through the Service. Decisions to apply for, accept, or remain in a position are made by you at your sole discretion and risk.
- We do not warrant that the Service will be free of viruses, errors, security breaches, or other harmful components.
Nothing in this section limits any rights you may have as a consumer that cannot be excluded under applicable law.
13. Limitation of Liability
To the fullest extent permitted by applicable law:
- We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation loss of income, profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
- Our aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) EUR 100 or (b) the amount you have paid us for the Service in the 12 months preceding the event giving rise to the claim. Because the Service is currently free, this typically means EUR 100.
- We are not liable for the actions, omissions, content, accuracy, or trustworthiness of other users or third parties (including advertisers, employers, or service providers).
- These limits do not apply to liability that cannot be excluded or limited under applicable law, including (where applicable) liability for: fraud, fraudulent misrepresentation, gross negligence, wilful misconduct, death or personal injury caused by negligence, or breach of mandatory consumer-protection rights.
14. Indemnity
You agree to indemnify, defend, and hold harmless JOSH, its directors, officers, employees, and agents from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
- Your User Content;
- Your violation of these Terms;
- Your violation of any third-party right (including privacy, intellectual property, or contractual rights);
- Your violation of any applicable law.
This Section does not apply to claims to the extent caused by JOSH’s own breach or fault.
15. Changes to These Terms
We may update these Terms from time to time. When we make material changes:
- We will notify you in the App at least 30 days before the new version takes effect;
- For changes that materially reduce your rights, we will require your active acceptance before continued use;
- A changelog is published on the website.
If you do not accept the new Terms, your sole remedy is to delete your account.
16. Beta and Experimental Features
We may from time to time offer features marked “beta”, “preview”, “experimental”, or similar. Such features are provided on a best-effort basis, may change or be removed at any time, and may have additional terms presented at the time of access.
17. Miscellaneous
17.1 Entire agreement
These Terms (together with the Privacy Policy and any policies referenced in them) constitute the entire agreement between you and us regarding the Service and supersede any prior agreement on the same subject.
17.2 Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
17.3 No waiver
Our failure to enforce any provision is not a waiver of our right to do so later.
17.4 Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, with notice to you.
17.5 Force majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control (acts of God, war, terrorism, civil unrest, pandemics, network or infrastructure failures, government actions).
17.6 Language
These Terms are originally drafted in English. We may provide translations in other languages (including Hungarian) for convenience. In the event of any conflict, the English version prevails, except where applicable consumer-protection law requires the local-language version to prevail.
17.7 Contact
For any question concerning these Terms:
Email: [hello@josh-app.example]
Postal address: [Full registered address]
18. Governing Law and Dispute Resolution
18.1 Governing law
These Terms and any dispute arising out of or in connection with them are governed by the laws of Hungary, excluding its conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods does not apply.
If you are a consumer resident in the EU, you also benefit from the mandatory protections of the consumer-protection laws of your country of habitual residence. The choice of law in this Section does not deprive you of those protections.
18.2 Jurisdiction
Subject to Section 18.3, the courts of Budapest, Hungary have exclusive jurisdiction over any dispute arising out of or in connection with these Terms. If you are a consumer, you may also bring proceedings in the courts of your country of residence, and we may only sue you in the courts of your country of residence.
18.3 EU online dispute resolution
If you are a consumer in the EU, you may also use the European Commission’s Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr to attempt to resolve a dispute out of court.
18.4 Out-of-court dispute settlement (DSA)
For disputes about content-moderation decisions, you may use a certified out-of-court dispute settlement body under Article 21 of the DSA. We will identify the relevant body in any Statement of Reasons.
19. Apple App Store Additional Terms
If you downloaded the App from the Apple App Store, the following additional terms apply:
- These Terms are concluded between you and JOSH, not Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- In the event of failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
- JOSH (not Apple) is responsible for addressing any claims relating to the App, including product-liability claims, claims that the App fails to conform to legal requirements, and consumer-protection or similar claims.
- JOSH (not Apple) is responsible for the investigation, defence, settlement, and discharge of any third-party intellectual-property claim regarding the App.
- You represent that (i) you are not located in a country subject to a US-government embargo or designated by the US government as a “terrorist supporting” country, and (ii) you are not on any US-government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
20. Google Play Additional Terms
If you downloaded the App from Google Play, you also agree to the Google Play Terms of Service. To the extent these Terms conflict with Google’s terms with respect to your use of the App as obtained from Google Play, our Terms govern only the relationship between you and us.
These Terms were last updated on [DATE]. By continuing to use the Service, you accept any changes that have taken effect.
